STATE REGULATION OF PRIVATE UNAIDED SCHOOLS

News: The Supreme Court held that the state cannot impinge on the autonomy of the private  unaided schools.

Supreme Court Guidelines:

  • It says the state cannot dictate the fees structure on the private unaided schools in the name of pandemic. 

  • This is the breach of autonomy of the private unaided schools.

  • State has a power to control their prices and fees only if they are indulging in profiteering and commercialisation.

  • State cannot stop the schools from charging just and reasonable fees.
