NATIONAL CAPITAL TERRITORY OF DELHI (AMENDMENT) ACT 2021

• From April 27 the National Capital  territory of Delhi (Amendment)act will come into effect.this act replaces the National capital territory of Delhi,  Act,1991.

• The law strengthens the powers of the Lieutenant- Governor of Delhi and impacts negatively on the powers of the elected government and the assembly.

• Provisions of the act:

  • It provided that the term “GOVERNMENT” in any act passed by the legislative assembly, refers to the LIEUTENANT GOVERNOR.

  • The procedure of rules of the Legislative assembly, can be framed by the Legislative assembly, however, they must be consistent with the rules of procedure of the Lok Sabha.

  • Administrative Matters: It prohibits legislative assembly to empowers itself/ any of its committed to enquire into the matters related to:

    • matters of day-to-day administration of the NCT of Delhi and 

    • conduct any inquiry in relation to administrative decisions. 

• Powers regarding the bills:

  • Lieutenant governor is bound to reserve following bill for the presidential assent:

    • diminishing the powers of the High Court of Delhi

    • which the President may direct to be reserved

    • Bill related to salaries and allowances of the Speaker, Deputy Speaker, and members of the Assembly and the Ministers.

    • relating to official languages of the Assembly or the NCT of Delhi.
